Disability insurance plans are designed to replace income that is lost due to illness or injury that is not incurred while on the job. Using disability insurance can be for short term or long term periods dependent on the nature of the cause and the recovery period and is available from insurance companies or self funded insurance. Disability insurance is regulated at the state level. Employers in most states are not legally required to provide disability insurance plans and only six states require that employees be protected by short term disability insurance plans, whether they are private, public or self funded. Even in these states, only minimal short term benefits are provided and there is no mandated long term coverage. There is a federal law that might apply to disability insurance, but it is for voluntarily established health plans in the private industry which sets minimum standards.

The first rule in using disability insurance is defining a disability within the parameters of a policy. It also needs to be established in disability insurance plans if the sickness or injury causes a disability in performing in the current occupation or all occupations that an individual is qualified by experience or education. These are obvious things, but need to be clarified prior to need because the distinction between these two forms establishes payment of claims.

Another rule in disability insurance plans is determining when and how long a provider will pay claims. The definitive period is established by the insurance company and varies greatly from policy to policy because each provider has its own definitions. Some insurers require a permanent disability before settling a claim and others will settle with partial disability when someone is recuperating and able to work on a part time basis. Some people have been using disability insurance for temporary situations because their insurance provider allow its use for periods of chemotherapy use.

There are different rules for different types of disability insurance plans. Using disability insurance requires a person know what particular type of plan they have according to the written policy. There are policies where the premiums are fixed over the term where rates or benefits cannot fluctuate and others that do not. Some disability insurance plans allow guarantees in renewal and others do not. The only way to know all the rules is to read the policy.
